How to Clear your Criminal
Record by Expunging your
California Criminal Conviction

STEP 1 - Terminate probation and
make final payment of restitution fees.

STEP 2 - Verify the case disposition
with the Superior Court of California -
felony or misdemeanor. Certain cases
cannot be expunged and some cases
may have already been dismissed by
the court.

STEP 3 - Serve the Prosecuting
Agency (District Attorney's Office or
the City Attorney's Office) with the
petition requesting a complete
dismissal of the case.

STEP 4 - File a Petition with the court
requesting an order to withdraw the
plea of guilty or the verdict or finding
of guilt to be set aside and a plea of
not guilty be entered as well as obtain
an order from the court to dismiss the
conviction pursuant to California Penal
Code section 1203.4 or 1203.4a. Also,
if applicable, petition the California
Superior Court to reduce the felony
conviction to a misdemeanor prior to
expunging the conviction.

STEP 5 - Obtain a certified copy of
the court's order expunging and
dismissing the conviction.

STEP 6 - Pursuant to California Penal
Code section 13151, obtain a court
order that directs the clerk of the
Superior Court of California to notify
the California Department of Justice
of the dismissal of the case.

California Criminal Record Expungement

Court to change your case disposition to reflect a "Not Guilty" plea and dismiss the
conviction pursuant to California Penal Code 1203.4 or 1203.4(a). With the internet
