California Criminal Record Expungement
The California Expungement Process allows you to petition the California Superior Court to change your case disposition to reflect a "Not Guilty" plea and dismiss the conviction pursuant to California Penal Code 1203.4 or 1203.4(a). With the internet making public information readily available, it is crucial to expunge your criminal conviction so that employers who conduct criminal background checks do not come across your conviction.

What Needs to be Done.

You have been arrested or charged with an alleged crime and have your arraignment coming up shortly.

Do NOT talk about the case with anyone, including family members. Immediately call our Firm for a Criminal Defense Consultation.

You were convicted of a misdemeanor and still on probation
|
Our Firm will file a motion to have your probation terminated. Upon successful termination of your probation, we will then file a petition to expunge your misdemeanor conviction.

You were convicted of a misdemeanor WITHOUT any probation.
|
Our Firm will file a petition to expunge your misdemeanor conviction. Your misdemeanor conviction will be set aside, vacated and dismissed through the expungement process.

You were convicted of a felony and are presently on probation
OR
You were convicted of a felony and served jail time with no probation.

If necessary, our Firm will file a motion to have your probation terminated. If your felony is a “wobbler,” one that can be reduced to a misdemeanor, our firm will file a motion to reduce the conviction to a misdemeanor prior to expunging the conviction. We will then obtain a certified court order indicating that your felony has been reduced to a misdemeanor and your misdemeanor conviction has been set aside, vacated and dismissed through the expungement process. If your felony conviction is not a wobbler, we will still expunge your record.
