California Criminal Record Expungement
The California Expungement Process allows you to petition the California Superior
Court to change your case disposition to reflect a "Not Guilty" plea and dismiss the
conviction pursuant to
California Penal Code 1203.4 or 1203.4(a).  With the
internet making public information readily available, it is crucial to expunge your
criminal conviction so that employers who conduct criminal background checks do
not come across your conviction.

1. What is an expungement?
In California, expungement is the process used to clear
your criminal record by petitioning to the court to set
aside, vacate and dismiss your conviction in its entirety.  
If you have ever been convicted of a crime, you may  
use the
expungement process to clear your criminal
record.


2. Why should I expunge my Criminal Record?
There are 4 good reasons why a person convicted of a
felony or a misdemeanor should hire a qualified
attorney to expunge their criminal conviction:
  • a.  Job Applications - Almost all employment applications, inquire as to whether the
    applicant has been convicted of a crime. By having your record expunged, your
    criminal record does not reflect a conviction. As such, you can truthfully answer that
    you are not convicted of a crime. Our firm will successfully set aside your guilty plea
    or you guilty verdict, vacate and dismiss the conviction in its entirety.

  • b.  Professional Licenses - Almost all applications for professional license and
    certifications inquire as to whether you have been convicted of a felony or a
    misdemeanor.  Expunging your record increases your chances of acceptance by the
    admission committee for professional licenses that obtain your criminal record from
    the Department of Justice - Livescan. Teachers, Realtors, Brokers, Nurses, Certified
    Nursing Assistants, and other professionals who have a conviction should obtain
    representation to successfully expunge and dismiss their criminal conviction. A
    successful expungement may allow you to obtain the professional license or
    certification that you have worked so hard to get.

  • c.  Independent Background Searches - Employers utilize private companies to
    conduct background searches on their potential applicants prior to hire. Majority of
    these search companies will first conduct a preliminary online search to inquire
    whether there is any convictions in the name of the applicant. If the applicant's name
    indicates a case with a conviction, they will then initiate the next step by sending a
    "runner" to the courthouse to retrieve the case disposition for the employer. If the
    applicant's name appears with a dismissal because of a successful expungement, the
    search company informs the employer that the applicant has no criminal convictions
    on file.

  • d.  Peace of Mind - Making sure that your criminal record does not reflect a
    conviction, provides for peace of mind. It is about time to bring closure to the
    mistakes that were once made. The California expungement process allows for
    finality. It allows you to put the past in the past. It allows you to look forward in your
    professional advancement without having the mistakes of the past haunt you.


3. How long does it take to get the case Expunged?
Penal Code §1203.4 requires that the Defendant or his Attorney to provide the prosecuting
attorney 15 days notice prior to the court granting relief. Our firm takes control of the entire
expungement process by constantly verifying with the probation department, the prosecuting
attorney, and the court to ensure that your case is expunged without delay. The entire
process takes about 4 to 6 weeks from the day your petition is filed with the court.
However, this still may vary from case to case and from court to court.

4. Can I have my Felony reduced to a Misdemeanor?
Certain felony convictions may be reduced to misdemeanors if the crime is classified as a
"wobbler." A wobbler always the prosecutor to file the case as a felony or a misdemeanor.
If you have been convicted of a felony that is a wobbler, we will first petition the court to
reduce the conviction to a misdemeanor and then expunge
the conviction.

5. Can I expunge a Felony Case?
Even if your conviction cannot be reduced to a misdemeanor felony convictions may be
expunged if you did not serve any prison time and you have completed your probationary
terms.

6. What If I am still on Probation, can I have my Probation
Terminated?
The courts have broad discretion to revoke, reinstate, modify, and terminate your
probation. Usually court will grant a motion for
early termination of probation if
the defendant has completed half the probationary period and has had no violations. Since
the courts have a broad discretion in modifying and/or terminating the terms and conditions
of your probation, our firm is successful in convincing the court that your
rehabilitation and good conduct warrants early termination of your probation.

7. What Are Some Limitations to a California Expungement?
Certain limitations apply to an expunged case depending on the conviction. Defendants are
to disclose the conviction in response to an application or questionnaire for public office,
state or local licensing, or contracting with the California State Lottery.
However, an expungement may act as a mitigating factor when applying for a professional
license or public office.

8. How much does it Cost to Expunge my California
Conviction?
