3. How long does it take to get the case Expunged? Penal Code §1203.4 requires that the Defendant or his Attorney to provide the prosecuting attorney 15 days notice prior to the court granting relief. Our firm takes control of the entire expungement process by constantly verifying with the probation department, the prosecuting attorney, and the court to ensure that your case is expunged without delay. The entire process takes about 4 to 6 weeks from the day your petition is filed with the court. However, this still may vary from case to case and from court to court. 4. Usually court will grant a motion for early termination of probation if the defendant has completed half the probationary period and has had no violations.
